Injury: Death (general)
If a person dies as a consequence of the actions of a liable third party, then a certain category of survivors can submit a claim. The following items can be claimed:
- funeral expenses;
- lost financial support;
- statutory interest;
- expenses in connection with legal assistance.
Lost financial support is usually the largest cost item (financially speaking). It regards loss of family income or loss of household support. Those who “stay behind” must be able to continue living at the level they would have lived had the death not occurred.
Maarten Tromp Advocaten has great expertise in death cases. It is for good reason that both Maarten Tromp and Paul Meijer teach “damages in the case of death” at Grotius Academy in Nijmegen as part of the Academy’s course on Personal Injury.
- A man is killed in an accident, leaving behind a wife and three children. His income is no longer paid out. Instead, his survivors receive a (meagre) benefit. The wife and the children individually have a claim for loss of financial support.
- A couple is living together and has three children. The woman runs the household, but is killed in an accident. Her survivors can submit a claim for loss of household support, so that they can hire someone to take over the mother’s household activities.
